California Laws Governing CalABLE Accounts

In 2023, the following statute was adopted
AB 339 (Irwin) – Increases the age limit of eligible individuals from 26 years of age to 46 years of age, commencing January 1, 2026.
In 2022, the following statute was adopted:
AB 2216 (Irwin) – Expands eligible contributions to CalABLE.
In 2019, the following statute was adopted:
AB 91 (Burke) – Eliminates differences in qualification criteria for ABLE accounts between federal and California tax law to increase contribution limits to up to the federal poverty level and allow taxpayers to roll-over Section 529 plans to ABLE accounts.
In 2017, the following statutes were adopted:
- SB 218 (Dodd) – Prohibits the state from filing a claim against a deceased beneficiary’s CalABLE to recover Medi-Cal repayment.
- AB 384 (Irwin) – Makes CalABLE a national plan that can accept account enrollment from qualified non-California residents.
- AB 688 (Calderon) – Exempts CalABLE accounts from the enforcement of money judgments.
In 2015, the following statutes were adopted:
- SB 324 (Pavley) – Established the California ABLE Act Board.
- AB 449 (Irwin) – Established the State’s 529A Qualified ABLE Program, CalABLE, opening up life-improving opportunities for people with disabilities and their families.
